Fender copyright ruling

According to, well, every single source about this case, that’s not quite it.

Fender won a default judgement, meaning the courts did not rule on the merits of the case. My understanding is that in Germany, default judgements do not establish precedent which can be used in other cases, because the court specifically did not rule that Fender’s copyright is valid. They will have to argue new cases on the merits from scratch.

Good catch. Keep in mind that these decisions can be appealed. I was trying to explain the basis of Fender’s claim (I am not defending it). I agree, it doesn’t create precedent and I wonder how solid the copyright claim may be. The question is whether the defendants can afford the legal fees to fight these claims.

I think Thomann is a billion dollar company, so maybe even bigger than Fender.

Regardless they’ve probably got a decent legal team :face_with_monocle:

None of this makes business sense to me.

It is, their revenues are about 1.5x Fender.

They should buy Fender for the trademark and then shut down the US subsidiary and just start labeling Bentons as Fender.

From everything I’ve heard, PRS is a really laid back guy but his company is everything to him. Vigorous defense would be putting it mildly.

Or, start making G&L’s designs and add those to the HB portfolio as their new premium tier. In every instance where I’ve been able to do direct comparisons, the G&L are superior instruments (SB 1 > P bass, ASAT > tele, Doheny > jazzmaster).

he is a treasure though. He’s famously opinionated and pretty blunt and it puts some people off, but he’s also hilarious. To me he comes across as pure dedication to his craft and it’s not an ego thing at all, he just doesn’t have patience for fools.

It’s too bad Gear Gods took down their channel because the NAMM interview they did with PRS was so damn funny. Watching the dude’s dream die in real time as his idol shredded his channel name :rofl:

I felt bad for him, Trey is great, but it was still an epic PRS moment.

From my experience, the Fenders would improve substantially!

Also, Thomann could establish Harley Benton as their boutique brand, while Fender would be for the kids that need to have a (once) “cool” brand. The ones that wear cool sneakers, ride longboards and buy vinyl :slight_smile:

The AI did a decent job for once on the bass, but it’s clear that the AI has never driven a car. Lane not wide enough for the SUV. No lane for the oncoming car driving on the sidewalk until it gets to the lamp post. Then what? :rofl:

Maybe the AI “thought” about European streets?
In my hood, SUVs have trouble getting into most streets, cause they are narrow and full with parking cars on both sides.
