So, Here is my Fate so far.
I plead guilty to lesser charges.
The Judge accepted my plea, and set sentancing for November 14th at 9:30am.

At sentancing I will find out my fate.
Max i could get is 20 years
Minimum is 3 years supervised release (probation)

After I get my sentance, I will likely remain out on bond, with a self surrender date sometime in Jan 2023, likely the beginning of Jan, but I should remain on bond thru the holidays, then go turn myself in for whatever sentance I get.

The Judge was very clear that there is no hint as to what my sentance will be.
There are many factors he needs to consider
What is my record (i have no record)

How have I been while on supervised release from when I was released from prison, 5 days after my arrest. (Pre trial probation)

All my medical issues

What prosecution suggests,

any arguments defense can come up with to show I should have a lesser sentance,
and
also being able to speak on my defense at the sentancing hearing.

So, I have no idea what my sentance is, but I have the rest of the year out on bond before I have to serve whatever it is.

I have a dumb guy question.
Why on earth does it take from May to November to come up with a sentence?
From my engineer side I would think the efficient thing to do is have the sentence all sorted if you take the plea etc today.
But I get not everything is that efficient (but should be), however 6 months seems just nonsensical.

Federal proceedings are very different then state or county or city proceedings.

I dont quite get it either.
But the way it goes, now I pleas guilty, and there is no jury trial, tge judge now needs to review everything.

I have been out on bond for over a year now. It took this long to get this far.
But alot of it is also to give me time for all my medical, and make sure my knees heal right, etc…
Its a strange process, thats for sure.

Bloody crazy system for sure but at least you have your freedom for a few more months.
To be honest it seems a bit unfair to let things drag on for such a long time. Do they not take into account the toll on your mental health?

Its kind of what we asked for, and there was no objection from prosecution.
It is really to allow me to have my knees fully healed and checked up on by my surgeon, and to get other things I have, healthwise.
I have appointments already scheduled thru July.

On May 31, I have a check up on BOTH my knees. That means that I get both knees xrayed, and then take those xrays with me to the appointment with the surgeon.
At that point, It will be 7 months for my right knee, and 2 for my Left knee.
Based on that, i will need check ups on my left knee at least thru 7 months, which is in November.
Thats when sentancing is.

I have a wisdom tooth, and the tooth next to it that need to be extracted by an oral surgeon.
I was going to have my dentist do it in March, but after xraying the wisdom tooth, and viewing the root, it had grown too close to my nasal cavity, and if extracted, it is possible for really bad bleeding in my nasal cavity that can be very dangerous, and a normal dentist has no way to stop that bleeding, so I am going to an oral surgeon in June, and have a dentist follow up and cleaning after that, in July.
Those are as fast as I can get on the schedule.
My insurance covers 100% of everything, zero deductable, zero co pays, but sometimes I gotta wait.

With Covid still a thing, the whole medical schedule is all backed up with ANY insurance, no matter how good or bad.

That is also true of the court systems, being backed up cuz of covid.

I could not get my court date moved up that much, but if I wanted a quicker sentance, and to not spend the holidays with family, I may be able to get it moved up to August, but it probably could not happen any quicker.

But thats also why they are allowing me to stay out on bond.
They are considering my mental health, they would be doing my mental health much worse had they taken me into custody, and kept me in jail til sentancing in November.

Part of a plea deal is me giving up certain constitutional rights.
By entering into a deal, I give up my right to a speedy trial, and right to a jury trial, among other things, so I guess they can do what they want.

In return tho, I dont have a minimum sentance of 20 years
I now have a MAX sentance of 20 years, and minumum of probation for 3 years (or what the Feds call 3 years Supervised Release), however, the plea agreement does not allow us to ask for anything less then 5 years.

The probation board could recommend less then 5 years, or even for just the min probation.
There are other reports and factors that could point towards the minimum.
The prosecution could even hint towards less then the 5 years,

My lawyer and I can not directly ask for less then 5 years.

Lots for the judge to consider, I think I rather him take his time with it, and not make any rash decisions cuz he was rushed.
Every day I am out of jail, NOT breaking laws., is like extra credit, so if he decided today, he would see I have not done anything bad for just over a year, his decision could be influienced one way, but in November, its almost 2 years, and if I have been good that whole time, then he might be more inclined to give me less time, and / or just probation.

But if I had to pick him deciding quickly over him deciding slowly, I think I rather him take his time, let all reports sink in.

I’ll keep everything crossed as always and hopefully the judge will see what you have been through/ are going through and take into account the effort you are putting in to keep on the straight and narrow.

@T_dub , you know i love ya. In glad you’re getting some time to get your affairs in order. Your stuff with doctors needs done well, and here in the world they actually care (sometimes) Abbott your treatment-inside? Well, you’re an inmate.
That conversation should just stop there, on account i got strong opinions and don’t want to irritate folks.

It’s good the sentencing will take a while. Gives you time to do the things you want to do, and allows the court to see you aren’t a threat.
